abstract:
Each right that belongs to the Universal Declaration of Human Rights has a corresponding duty: if I have a right to something, someone else will hold a respective duty. But who? The risk of failing to answer this question is to have human rights lose efficacy, and ultimately, credibility. This paper will first expose the scientific debate on the identification of duty-bearers, focusing on the dichotomy between the institutional and the interactional view. Subsequently, it will promote the interactional view, arguing that the opposing institutional view leads to an unjustified weakening of individual responsibility, that in turn compromises the enforcement of human rights. In contrast, the interactional view here adopted will propose a maximalist interpretation of human rights and their corresponding duties.
